The terms and conditions below apply to all listening and self-development services provided by Hear. You., a service exclusively for women, to any individual and constitute the contract for the service to be provided by Hear. You. for the client. The terms 'listening' and 'self-development' as used here cover services aimed at providing emotional support, personal development, and well-being enhancement tailored specifically for women.

In the spirit of good practice, you are asked to confirm that you have read and agreed to each statement below when purchasing services and that you wish to proceed.

All services and communication, whether by email or otherwise, delivered by Hear. You., as well as information on this website, are intended to support you as a woman in managing life stressors and emotional challenges. It is important to note that these services are not a substitute for professional mental health care or medical care.

Disclaimer

In committing to working with Hear. You., you acknowledge the following:

• You understand that the services you will be receiving are not a substitute for professional mental health care or medical care and are not intended to diagnose, treat, or cure any mental health or medical conditions. You also understand that Hear. You. does not provide therapy or mental health counseling services.

• You acknowledge that the listening and support services provided by Hear. You. are currently part of an unregulated industry and that Hear. You. is not "licensed" or "accredited" by any formal organisation.

• You agree that you are fully responsible for your well-being during your sessions and subsequently, including your choices and decisions.

• You understand that all suggestions and ideas offered are solely for the purpose of supporting your personal development and achieving your self-defined goals. Results are not guaranteed, and you have the ability to give your informed consent for participation in these services.

Data Protection

You understand that your personal information will remain confidential unless you state otherwise in writing. If you report instances of child abuse, elder abuse, neglect, or if you threaten to harm yourself or someone else, Hear. You. may take necessary actions, and your confidentiality agreement may be limited in this capacity. Additionally, if required by UK law or court order, Hear. You. may be obligated to provide information or testify.

Data Security

You acknowledge that the use of technology is not always secure, and you accept the risks associated with confidentiality when using email, text, phone, Zoom, Microsoft Teams, or any other technology.

Waiver

You hereby release, waive, acquit, and forever discharge Hear. You. and its successors, assigns, personal representatives, executors, heirs, and employees from any and all claims, suits, actions, demands, or rights to compensation for damages that you may claim to have or that may arise.

You further declare that no promise, inducement, or agreement not expressed in this agreement has been made to you to sign this agreement. This agreement shall bind your heirs, executors, personal representatives, successors, assigns, and agents.

Terms & Conditions

In return for the fees payable by the client (or by a third party on their behalf), Hear. You. agrees to provide the service as described below and in accordance with the terms and conditions set out below. The client agrees to pay fees for the service on the terms and conditions set out below. Participation by any individual in the first session constitutes acceptance of these terms and conditions.

Format of Sessions

Sessions are conducted by phone or internet via Zoom, Microsoft Teams, or telephone. Hear. You. is open to other formats by mutual agreement. Hear. You. is responsible for ensuring availability for consultation at agreed times.

The length of each session is set by the client at the time of booking and is paid for accordingly at the time of booking.

Session Fees

Hear. You.’s current fees are stipulated on the website and are made clear at the time of booking. Hear. You. reserves the right to change these from time to time. Any payments for sessions paid in advance are honored even if prices have risen between the point of booking and the time of session.

Dates and Times of Sessions

The date and time of the first session and any subsequent sessions will be confirmed at the time of booking. Hear. You. agrees to maintain availability as presented by the online booking platform and to honour the sessions booked through the platform.

Payment Terms

Fees can be paid online by debit or credit card. Receipts and/or invoices are available upon request and will be sent by email.

Fees are payable in advance of each session unless otherwise agreed. If payment has not been received in advance, Hear. You. is not obliged to provide the session.

Refunds will be provided for prepaid sessions at the request of the client. If the client has used their sessions, no refunds will be given.

Between Sessions

Hear. You. may suggest tasks or exercises to complete between sessions. There is no obligation on the client to complete these tasks, but not doing so may slow the client’s progress.

The client may contact Hear. You. by email between sessions to seek clarification regarding anything arising from a session or for administrative purposes (e.g., to rearrange a session or make a payment).

Rearranging Sessions

If a client needs to rearrange a session, they should provide at least 24 hours' notice. No refunds will be given for unused sessions unless 24 hours' notice has been provided. In exceptional circumstances, Hear. You. may need to rearrange a session and will give the client 24 hours' notice where practical.

Confidentiality

Personal or business information supplied by clients in sessions will be treated as confidential and will not be disclosed to a third party without the client’s prior permission, save where required by law or where action might be necessary to prevent harm.

Early Termination

In exceptional circumstances, such as illness, inappropriate behavior by the client, conflict of interest, or other reasons, Hear. You. reserves the right to terminate the service early. In such circumstances, the client will be given reasonable notice where practicable and will be refunded any advance payments for sessions not yet provided.

Responsibilities

Hear. You. will seek to enable the client to improve their quality of life and achieve their desired outcomes. However, the client has sole responsibility for taking important decisions in their life. Hear. You. has no liability for any loss incurred by any client, whether financial or otherwise, following commencement of sessions, or for any perceived failure to achieve improvement in quality of life or desired outcomes.

Variation of Terms & Conditions

Hear. You. may change any of these terms or conditions, including the Per Session Fee, by giving the client one week’s notice in writing by email of the change(s). If the client no longer wishes to proceed with further sessions, they may withdraw from the service immediately by giving notice in writing. They will be entitled to a full refund of any fees paid in advance for sessions not yet provided.
